We do not accept credit cards. We accept Cash, Cashiers checks, good in-state personal check hand-delivered, ACH payments (a one-time debit out of your bank account), Wires (Add $20 wire fee). All forms are available on our Website. We require new buyers to show us a letter from their bank showing they have the funds to cover their purchases. We are no longer taking payments by mail. Online purchases will have a premium of 10% charged per item with a $1500 cap per item. Sales tax will be charged on buyers premiums. Online purchases must be paid within 3 business days of purchase. Nothing removed unless settled for and paid in full. All items purchased on any auction must be removed in 30 days. Note: a storage fee will apply after 30 days. After 60 days any items not removed will be considered abandoned and permanently destroyed. Both live and online bidders are asked to make their own inspections of the equipment as other than our ride and drive policy all sales after the winning bid are final and bidders understand that all equipment is sold as is - where is - with no guarantees or warranties. Note: Any non-paying bidders will be removed from future auctions both live and online for non-payment of items purchased and may also incur late fee penalty and court proceedings may ensue after that.
Terms of Purchase: Buyer acknowledges & agrees as follows: Joel's Tractors & Auctions, LLC, collectively are released from liability for all items sold, no exceptions. All equipment & other tangible property (collectively "Property") is sold on a "AS IS, WHERE IS, WITH ALL FAULTS" basis and no warranty of any kind, expressed or implied is given by Joel's Tractors & Auction (unless publicly posted by Joel's Tractors & Auction or agreed to in writing signed by Joel's Tractors and Auction & buyer). Buyer is invited, urged & cautioned to inspect the property prior to purchase. Joel's Tractor & Auction MAKES NO REPRESENTATION OR WARRANTY ABOUT THE PROPERTY INCLUDING WITHOUT LIMITATION THE PERFORMANCE ABILITY OF THE PROPERTY, ITS PRESENT STATE OF REPAIR, ITS CONDITION OR MAINTENANCE, OR ITS ABILITY TO FUNCTION IN ANY RESPECT. Buyer has not relied upon or been induced by any statements or representations of Joel's Tractors & Auction as to any matter affecting the property that might be pertinent in considering the purchase. Title to & risk of loss or damage to the property purchased by buyer will pass to buyer at the time buyer is invoiced for the property, and buyer assumes all risk of loss, damage to the property or damage caused by the property, while left on the premises of Joel's Tractors & Auction and thereafter. Purchases of property must be paid in full before the property is released from Joel's Tractors & Auction premises. Removal of the property shall be at the sole expense, liabilty and risk of the buyer. Joel's Tractors & Auction EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY & THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. Joel's Tractor & Auction's liability with respect to the property sold to buyer will be limited to the purchase price paid by buyer. In no event, Whether based on contract, indemnity, warranty, tort (including negligence), strict liability, or otherwise, shall Joel's Tractors & Auction be liable to the buyer for special, indirect, incidental or consequential damages whatsoever including, without limitation, loss of profit or revenue. The terms of this invoice supercede all prior negotiations, representation statements, understandings & agreements.
